TERMS OF SERVICE

NOVA SEC AUSTRALIA

Last updated: 14 Jul 26

What these terms cover

These terms apply to your use of novasec.au, operated by Nova Sec Australia (ABN 16 926 391 567) ("Nova Sec").

They do not govern consulting work. If Nova Sec does work for you, that is covered by a separate written engagement agreement, and that agreement takes precedence over anything on this page.

Nothing on this website is an offer to enter a contract.

Using this website

Use it lawfully. Do not attempt to interfere with it, gain unauthorised access to it, or use it to harm anyone.

You must be 18 or over to engage Nova Sec's services.

Who Nova Sec will and will not work for

Nova Sec Australia operates under professional, ethical and legal obligations, and these govern who it will act for and on what terms.

Nova Sec applies the following conditions to every engagement without exception.

Identity and authority. Before any engagement begins, Nova Sec will verify the identity of the client and confirm that the person instructing it holds the authority to grant access to the systems concerned.

Written authorisation. Nova Sec will not test, probe, scan or access any system without prior written authorisation from the party entitled to give it. Authorisation from a party without that entitlement is not sufficient and will not be relied upon.

Refusal of engagement. Nova Sec will decline any engagement where it holds reasonable grounds to believe that the work, or its output, would be used for an unlawful purpose. Nova Sec may terminate an engagement in progress on the same grounds.

Disclosure obligations. Where the law requires Nova Sec to report a matter to a regulator or law enforcement agency, it will do so. These obligations sit above any duty of confidentiality owed to a client and are not subject to waiver.

What's on this website

The text, layout, graphics and logos on this site belong to Nova Sec Australia unless stated otherwise.

You are welcome to read it, quote it with attribution, and send it to someone who would find it useful. You may not republish it as your own or pass it off as someone else's work.

Accuracy

The content on this website is general information. It is not advice for your specific situation.

Standards change, legislation changes, and this site is maintained by one person. It is kept current in good faith. Before you act on anything here, talk to someone about your actual circumstances.

Nova Sec is not a law firm. Nothing on this website is legal advice.

Links to other websites

Some pages link to other websites, including the Australian Signals Directorate, the Office of the Australian Information Commissioner, and certification bodies. Nova Sec does not control those sites and is not responsible for their content, their availability, or their privacy practices.

Liability

To the extent permitted by law, Nova Sec is not liable for any loss arising from your use of this website, from anything you relied on here, or from any interruption to it.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where the law permits Nova Sec to limit its liability, that liability is limited to resupplying the service or paying the cost of having it resupplied.

Liability for consulting work is dealt with in the engagement agreement, not here.

Privacy

How Nova Sec handles personal information is set out in the privacy policy. Read the privacy policy →

Changes

These terms will be updated when Nova Sec's practices change. The version number and date at the top tell you when that last happened. Continuing to use the site after a change means you accept the current version.

Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute will be dealt with by the courts of Victoria.
